What to do if you are fined for being uninsured

Η ώρα για την οποία… προειδοποιούσε το TopSpeed.gr, ήρθε. Η Ανεξάρτητη Αρχή Δημοσίων Εσόδων άρχισε, από την Παρασκευή, την αποστολή μέσω του Taxisnet of the fines (€250) for vehicles found uninsured during the automatic system check on 6 June. This, of course, does not mean that chaos has been avoided.

Among the 1.1 million noticesIncluded are thousands of cars that have been reported stolen and have not been found, have been permanently deleted, but even those that have been transferred a few hours or 24 hours before and their owners have not had time to put them in tax immobilization or the system has not been informed that they are insured!

 In these cases, holders will pay fines, or they will have to enter a a maze of bureaucratic chaos, informing all the relevant authorities of the obvious, namely that their car is insured, carrying from office to office the insurance policy document. The owners of uninsured cars will now have to pay Receipt EUR 250 to the tax authorities to manage to secure their car.

So what should you do if you also received the administrative sanction? The Topspeed.gr made a mini “οδηγό” με απαντήσεις to the main questions, based on the data released by the ADEA:

-How do I know if the act imposing the fine concerns me?

By logging into your Taxisnet account, using your passwords, you will see the message from the Hellenic Tax Authority. Attention: The sending of the messages has not been completed.

Στα ειδοποιητήρια, μεταξύ άλλων αναφέρεται: «Σας γνωρίζουμε ότι κατά τη διασταύρωση που διενεργήθηκε στις 06/06/2017, του αρχείου του συνόλου των κυκλοφορούντων οχημάτων και του αρχείου των κυκλοφορούντων με ασφαλιστική κάλυψη κατ’ εφαρμογή των διατάξεων του άρθρου 5α του Π.Δ.237/1986, όπως ισχύει, προέκυψε ότι το ανωτέρω όχημά σας ήταν ανασφάλιστο. Το γεγονός αυτό αποτελεί παράβαση της ισχύουσας νομοθεσίας και επισύρει τις κυρώσεις που προβλέπονται από τις διατάξεις της παρ.4 του άρθρου 5 και του άρθρου 12 του Π.Δ.237/1986, όπως ισχύει.
Κατόπιν των ανωτέρω θα πρέπει να προβείτε άμεσα στην ασφάλιση του οχήματος, έχοντας προηγουμένως καταβάλει την αξία του προβλεπόμενου από τις ίδιες διατάξεις παραβόλου, ύψους διακοσίων πενήντα (250) ευρώ”.

-What should I do now that I have received the notification?

You must issue an insurance policy immediately. To do this, you will need to obtain a voucher from the e-Payment application at www.aade.gr. On the page there is already a ready-made voucher for you, with the same protocol number as the number of the letter sent to you by the AADE.

-I received the fine, even though my car is insured since 7/6, before the notification of the ADEA came. Will I have to pay a fine?
If it was uninsured at the time of the electronic cross-check (6 June), yes. In short, you will pay the extra fee to avoid having your plates taken away.

-The AADE sent me the fine, but unfairly, since my car was properly insured when the crossing was made. Who should I contact?

Your insurance company: The AADE says that they must take the necessary action.  

-On the date of the crossing, when the fine was confirmed by the ADSE, my car was immobilized.
In this case, or if you have received a fine for a car that has never belonged to you, or has changed its registration number, or has been deleted, you must apply to the tax authority.Make sure you have the necessary documents with you (certificate of immobilisation or history of changes to the vehicle in question from the competent Regional Transport Service, where the vehicle's registration has been issued, etc.)

-I was sent a fine for an uninsured car that no longer belongs to me.

You should contact the Regional Transport Authority.

-I have been fined for a car that is in the process of being transferred.

If you have applied for the transfer of the vehicle to a K.E.P. and the new registration permit has not yet been issued, you should apply to any D.O.Y. by presenting the relevant certificate of the K.E.P. for the submission of the transfer request.

-Με… πρόλαβε η Τροχαία, εντοπίζοντας το ανασφάλιστο αυτοκίνητό μου και βεβαιώνοντας τις ανάλογες διοικητικές κυρώσεις. Πρέπει να πληρώσω και το παράβολο και την κλήση;

No. In this case, you will not have to pay the €250 fee. However, before issuing an insurance policy, you will have to go to any tax office and present the relevant act of the police authority notifying you of your exemption from the obligation to pay the fee.

-What happens if I don't pay, if I ignore the notice?

If no action is taken, within two months from the day the notice was sent, the relevant police authorities will be notified to remove the registration details (licence and number plates) of the uninsured car. The latest information indicates that the removal will take place for six months.
